legaZPI CIty (3 DeCember) — offICe of the Civil Defense (OCD) regional director Rafael Alejandro IV disclosed on Thursday that during the OCD updating conference on Mt. Bulusan at Camp Simeon Ola in this city, PHIVOLCS resident volcanologist for Bicol, Eduardo P. Laguerta warned that an estimated 100,000 cubic-meters of
ashfall deposits on Mt. Bulusan’s upslope threatens to inundate the four river channels at the base of the volcano once these are triggered by heavy rains. During an aerial inspection conducted by PHIVOLCS last Wednesday morning, volcanology experts estimated some 466,000 cubic-meters of ashfall deposits were yielded
from the crater of Mt. Bulusan during its nine phreatic eruptions since November 6 this year. Laguerta claimed that currently, small lahar and debris flow were observed during occasional rains along the river channels in Rangas river in Juban town and connecting river channels of Cogon, Monbon, and
Patag, all in Irosin, Sorsogon. Laguerta added that lahar threat to communities downstream of the four river channels was still possible should there be prolonged intense rain-fall or an incoming typhoon. Director Alejandro said that currently

Robredo wants additional benefits for barangay officials
CanDaba, PamPanga, noV. 28 -– InterIor and Local Government Secretary Jesse Robredo has underscored the need to amend the Local Government Code that would provide additional protection and benefits to barangay-elected officials. Robredo made this statement during the recent mass oath-taking of all newly elected Barangay and Sangguniang Kabataan officials in 33 villages here held at the Ms. Earth Park in Barangay Mandasig. “There is a need to amend the Local Government Code that would pave the way for more benefits to our elected local officials,” Robredo said. He said that with the existing laws governing the concerned officials, “they (barangay and SK officials) are not even classified as government employees.” In fact, he said, they were only receiving honorarium as public servant. “We will push that they be considered government employee in order for them to

Re-computations
CaSureCo II PreSIDent nIxon tabora has recently issued a statement that the power cooperative will no longer honor “re-computed” electric bill payments of its consumer-members based on the July 6, 2010 court decision of Judge Marvel Clavecilla of RTC Branch 33. Tabora reasoned that the two institutions undertaking the recomputations were not legally authorized to do so, namely the Naga City Government Legal Office and the Integrated Bar of the Philippines (IBP) Camarines Sur Chapter. Tabora, a lawyer, thus pointed out that such “re-computations” had no legal basis and therefore Casureco II is not bound to accept them.

WIth ChrIStmaS faSt aPProaChIng, my 10year old daughter Caitlyn kept reminding me to put up our Christmas tree. When I did so finally, she was very excited helping me. And as we put in the tree’s branches and leaves, I also sang her favorite Christmas song: “Santa Claus Is Coming to Town.” She believes in Santa, and every year she gets a gift from Santa. But soon perhaps she may get into that situation Virginia O’Hanlon found herself in as an eight year old. Virginia then wrote The Sun: “Dear Editor-I am eight years old. Some of my little friends say there is no Santa Claus. Papa says, ‘If you see it in The Sun, it’s so.’ Please tell me the truth, is there a Santa Claus?” Francis P. Church wrote this editorial of The Sun on September 21, 1897, which reply has become a classic— “VIRGINIA, your little friends are wrong. They have been affected by the skepticism of a skeptical age. They do not believe except they see. They think that nothing can be which is not comprehensible by their little minds. All minds, VIRGINIA, whether they be men’s or children’s are little. In this great universe of ours man is a mere insect, an ant, in his intellect, as compared with the boundless world about him, as measured by the intelligence capable of grasping the whole of truth and knowledge.” “Yes, VIRGINIA, there is a Santa Claus. He exists as certainly as love and generosity and devotion exist, and you know that they abound and give to your life its highest beauty and joy. Nobody can conceive or imagine all the wonders there are unseen and unseeable in the world. “You tear apart the baby’s rattle and see what makes the noise inside, but there is a veil covering the unseen world which not the strongest man, nor even the united strength of all the strongest men that ever lived, could tear apart. Only faith, fancy, poetry, love, romance, can push aside that curtain and view and picture the supernal beauty and glory beyond. Is it all real? Ah, Virginia, in all this world there is nothing else real and abiding. “No Santa Claus! Thank GOD! he lives, and he lives forever. A thousand years from now, VIRGINIA, nay, ten times ten thousand years from now, he will continue to make glad the heart of childhood.”

While such logic of Tabora seemed unassailable, it is however betrayed by the crucial fact—conveniently ignored in this case—that Casureco II has been legally proscribed by an RTC court order from charging its consumers more than the March 2010 power rate which is P4.8939/kWh. In other words, although it can be admitted that both the IBP and the City Legal Office are not mandated per se to make “re-computations” of consumers’ power bills, it must also be acknowledged that Casureco II management has no legal authority either to charge consumers more than P4.8939/kWh. The former results from the latter. If Casureco II wishes for IBP and the City Legal Office to desist from “meddling” with the power coop’s computation of its consumers’ electric bills, it must also cease defying the RTC order barring it from illegally charging consumers higher power rates. In retrospect, what Tabora’s statement calls attention to really is Casureco II management’s defiance of the law and the law’s lack of teeth in biting it back. Granted that the power cooperative has filed a motion for reconsideration on Judge Clavecilla’s July 6 ruling, it remains bound nonetheless by that court order until a formal resolution in issued. And yet, Tabora et al persist in their defiance of that court order, of the law. They ought to be cited for contempt of court and appropriately penalized.
Days of Infamy
the 8th of DeCember In the Catholic calendar is Immaculate Conception, a mystery of infinite density that non-Catholics would find allure in. Years and years ago, in 1941, this tremendous mystery, however, vanished with the skies filled by what were called then enemy planes. That day was the beginning of the Second World War in our country. Hours before that – the 7th of December to be exact – Pearl Harbor in idyllic Hawaii was bombed. If we are to believe the narrative of the United States, the missive from Japan declaring war came minutes after the U.S. base in the Pacific was in shambles and ruins. There was treachery therefore and deceit of the highest evil order. I am curious though: what was the world before this day in 1941. If we are to use the words of the ultimate conquistador, Napoleon, to him is attributed the quotation: “History is the version of past events that people have decided to agree upon.” If we are to the chronicle of those days as their remembrance had been agreed upon, then we come upon a world that was on the verge of both glory and gore. The year 1940 saw the rise of Carson McCullers and her first novel, “The Heart is a Lonely Hunter,” a story about outcasts and misfits. Richard Wright in his review states how “Miss McCullers’ picture of loneliness, death, accident, insanity, fear, mob violence and terror is perhaps the most desolate that has so far come from the South.” The same critic writes of the style of this new voice and how she “recounts incidents of death and attitudes of stoicism in sentences whose neutrality makes Hemingway’s terse prose seem warm and partisan by comparison.” In that stoic prose, Hemingway would grace the 1940s with his “For Whom the Bell Tolls.” In the middle of World War, in 1943 when thousands were dying from bullets and lack of food, Hollywood would issue the film version of this novel in the tradition of extreme romance starring Gary Cooper and Ingrid Bergman. Raymond Chandler releases his “Farewell my Lovely” during this year. The other ominous farewell signs were there already: Germany initiates its conquest of certain territories, starting with Paris, Denmark and Norway. Italy declares war and even advances to southern France. Then Japan joins the Axis. As the world, without its knowing it, bids to any notion of peace, somewhere in France, in the cave of Lascaux, prehistoric paintings are discovered. This cave art a testimony to the ancient desire of man and woman to control the universe through the magic of art and the power of the mind. By 1941, Joe DiMaggio has set a new record in baseball. Germany marches on, to Greece and Yugoslavia. Germany also invades in 1941 the Soviet Union. Germany tries to reach Moscow but is repulsed by the violence of winter. During this period, the German playwright, Bertolt Brecht, writes his play “Mother Courage and her Children,” a theater piece producing this line “War is like love, it always finds a way.” An example of the Epic Theater, the play is considered to be the greatest anti-war play for the 20th century. Love, unlike in the play, will lose its way during the year of 1941. Greta Garbo, considered to be the greatest actress and the most beautiful, retires already by this year, afraid, according to some source, to grow old before her fans. Living long after the war has ended, Garbo would be a recluse and thus retaining—in the memory of those who last saw her before Japan joined the war—the beauty of the face as it was in the year 1941. The memory of war persists. Long after it has ended and even after the 8th of December is observed in peace again by Catholics as the Feast of Immaculate Conception. Memory, however, is deceiving. Hemingway of 1941 would be our prophet with his novel the title of which is taken from John Donne’s Meditation No. 17 written in 1600, years and years before the infamy of 1941. Completing that line, we hear this: “No man is an island, entire of itself; every man is a piece of the continent, a part of the main. If a clod be washed away by the sea, Europe is the less, as well as if a promontory were, as well as if a manor of thy friend’s or of thine own were: any man’s death diminishes me, because I am involved in mankind, and therefore never send to know for whom the bell tolls; it tolls for thee.” In 1941, no one could ask for whom the bell tolls; it sadly for everyone tolled.

a Double Standard in the administration of Justice

Antonio Trillanes IV and his colleagues who participated in the Oakwood mutiny and who later stood their ground amid offers of the previous administration to sacrifice their principles in exchange for their freedom would finally be released, most probably before Christmas. Rightfully so, because their only ‘crime’ was their refusal to continue receiving orders from an upstart dictator who kept herself in power through bribes and repression. Although there may be questions regarding the manner of their release because by receiving amnesty one is presumed guilty, it would result in their freedom nevertheless. The process of their release was fast-tracked by the order of Pres. Benigno Aquino III to grant the mutineers amnesty even before the court has completed its hearings on the case filed against them. And the grant of amnesty had to be approved by Congress before being effective. It was supposed to be a three-step process – the court has to decide on the case; the president then orders the grant of amnesty; and Congress has to approve it – but was fast-tracked by a show of political will of the Aquino administration. Unfortunately, the same could not be said with regards the case of the Morong 43. Twice, President Aquino rejected the calls of groups, locally and internationally, for the release of the Morong 43. During the first instance, his reply was to let the court decide but he admitted that there were a lot of irregularities in the search and arrest warrant so he ordered the Department of Justice to review the case. However, when Justice Sec. Leila de Lima submitted her recommendations, it was reviewed again by the Malacañang legal staff. After the review of the review was submitted, President Aquino would say the same thing again: let the court decide. Why would there be a different standard of justice for the Oakwood mutineers and the Morong 43? If the only “crime” of the Oakwood mutineers is to protest against an upstart dictator, the only “crime” of the Morong 43 is to ensure that health services reach the poor in remote areas and that they belong to progressive organizations, which has consistently protested against the same upstart dictator. Jose V. Cabrera , a lawyer for 20 years and a member of the board of governors of the Integrated Bar of the Philippines, made it perfectly clear how simple it is for President Aquino to effect the release of the Morong 43: by simply ordering the prosecutors from the Department of Justice to withdraw the case. After that, he said, the court would have no choice but to drop the case. It is just a two step process. Actually, the case of the Oakwood mutineers is much more complicated. The amnesty order still had to pass through Congress. Furthermore, in the case of Sen. Trillanes and his co-accused, Pres. Aquino did not think twice about preempting the decision of the court. Why is it then that with the case of the Morong 43, President Aquino suddenly found it appropriate to wait for the decision of the court? Clearly, there is a double standard in the administration of justice in the case of the Oakwood mutineers and that of the Morong 43. In a democracy, “the law should apply equally to all” otherwise there would be political prejudice. In this case, it is clear where the balance of justice weighs heavier. And only a stonger act on the part of the people could pressure the Aquino government to correct the injustice being committed against the Morong 43. (Bulatlat.com)

InnoVatIonS In CommunICatIonS are not only limited in the four corners of the classroom, neither it is only accessible to offices or digital workplace, but it can also be found even in our own university’s libraries. This premise supports the University of Northeastern Philippines (UNEP) digitization program, making sure that technological innovations doesn’t only stop in their computer laboratories but also spreads in other departments. This is also in line with their mission to provide the latest innovations in technology and communications to its faculty and students. In line with this, UNEP library spearheaded a one-day seminar on Information Literacy and Technology on December 3, 2010 at the UNEP Mini theater. It was participated in by book buffs, most specifically students, librarians and library users. Salazar, UNEP University librarian. Salazar said that endeavors like this is a welcome opportunity for every participant to have an easy access to information and find ways to easily retrieve information materials using new methods of research. “This seminar will surely provide us with personal, economic and cultural advancement, while we are also given an opportunity to use it in dealing with our clients and improve the delivery of our services.” Lectures who graces the said occasion were Dr. Ellen C. Cutiongco, a retired UP Professor and 2009 MetroBank Awardee for Continuing Excellence and Services (ACES); Mr. Edgardo B. Quiros, IT Professor and Head of the National Library of the Philippines and Mrs. Walditrudes R. Mesias, a retired Associate Professor from Bicol University. Atty. Remelisa Alfelor-Moraleda, UNEP President believes that this endeavor will help the librarians and other participants in appreciating what modern technology can do to improve their craft, most specifically their service to the library users. “There is a parallel need to develop a conceptual base for the effective and widespread use of Information Technology. We can make use of this learning to make us as “wise information consumers” and a well-motivated life long learner of information literacy.” UNEP library is already adopting the On line Public Access (OPAC) which has facilitated library work, making the faculty and students’ access to references now a lot easier. Book collections, including recent editions, were also added to the library. Easy retrieval of information utilizing free library software called LIBRO System is now being use by the library.

The prelate lamented cases filed in courts had been there for as long as people of Marinduque can remember but the Boac River had never been restored and the people’s lives had never been repaired. “The most important thing here is environmental justice that the Diocese of Boac and the whole Marinduque province are hoping for,’ Evangelista said. “(But) until now, talks are at slow pace. The case has already been filed but we are not sure how many years or decades it will take.” The bishop called on the Aquino administration to give due attention to their problem so as the long-awaited justice be satisfied for the victims. With the aggressive campaign for mining even in their province, Evangelista said it seems that the government has not learned from the past. “This is what we feel, what the people feel. Until now, the government continuously pushes mining in the country,” the 47year old prelate said. Recent Aquino administration’s pronouncements that it will continue to pursue mining as an economic policy has also alarmed mining affected communities, anti-mining activists and advocates. Attorney Mario Maderazo of the Philippine Miserior Partnership – Anti Mining Campaign said, “We don’t think that this direction is the right path towards the ‘straight path’ that Aquino has promised to embarked into.” “Mining historically has only brought devastation, misery, death, human rights violations, as what was clearly shown by the horrific experiences in Marinduque,” he said. Dear Editor, My appreciation for another budget airline servicing the Manila-Naga route rapidly turned to disgust after five cancelled flights in just two months. The most recent cancellation was last Nov. 25, when I was ironically flying on a replacement ticket for a previously cancelled flight. The reasons given are invariably “air craft situation” and “sunset limitations in Naga.” We were also promised the alternative of a free 8-10 hour overnight road trip (vs. a 50-min flight) aboard a business class bus but were boarded on a cramped freezing bus without a restroom instead. The reason? No available business class bus. After the first cancellation last October, I suggested that the flights be scheduled earlier to eliminate at least the sunset limitation reason. AirPhil did move the flight half an hour earlier, but that didn’t prevent more cancellations in the following weeks. If their planes are in such a bad condition, should AirPhil have been granted a franchise? Is the airline just scrimping because the cost of busing, hotel accommodations and dinners is still much lower than that of aviation fuel and contracted pilots? Or could the reason be sabotage since the staff is currently protesting the PAL management policy of labor contracting? “Pasensya na po” is a nice humble Pinoy expression, and indeed we have been quite patient, but patience of this kind has just bred abuse. Government should investigate this airline’s operations immediately and stop it from offering more promo flights only to cancel them later. AirPhil should compensate the passengers for moral and actual damages we have suffered from the frequent cancellations. We, the stranded passengers should ‘shout out’ our negative experiences on social networks such as Facebook, and now even seriously consider a class suit against the airline. P 250-Million earmarked by the Arroyo government for the total rehabilitation of the highway. Atutubo said that since the major rehabilitation works in the highway were started five years ago, none of the completed section has yet been handed-over for road maintenance by the DPWH engineering district office. Reportedly, a joint venture of contractors, the NFH and PERSAN construction firms, are still under contact to maintain finished sections of the highway until the entire contract of the rehabilitation is completed. Recent inspections by the DPWH engineers showed that earlier completed sections along the Camarines Sur boundary of the Andaya Highway in Del Gallego to Tagkawayan, Quezon are now beginning to deteriorate. An engineer in the regional office had remarked “that the government had spent millions in funds for the rehab, but often times during reblocking and the asphaltoverlay works no DPWH engineers were present to check on the quality of the of the works.” In late 2005, the national government initially ordered the release of some half a billion pesos, most of which was to start the Andaya Highway repairs; in 2008 another P350-Million were released to intensify the rehabilitation efforts.

Kung ito ay bahay ng isang masungit at matapobre, ay hindi kaya dapat resibidor muna ang mapapasukan ng isang bagong dating? Sa resibidor ang isang panauhin ay hindi pa tiyak kung makakapasok sa kabahayan. Maliit na espasyo ito na may silya o sofa na paghihintayan habang abala o iniisip ng may-ari kung ang bisita ay karapatdapat harapin o papasukin sa loob ng bahay. Maaaring nabago na ang ayos ng dating bahay. Pero wala namang ibang lugar na maaaring masabing dating kinalalagyan ng komidor. Dahil ang kainan, kahit noong araw ay palaging hindi kalayuan sa kusina at banggerahan. At sa palagay ko, iyong lumang eskaparate, kahit hindi na antigo ang mga nasa loob na plato at kubyertos, ay matagal nang panahong hindi nakapamasyal kahit saan. Puwede rin sigurong may tabing ang panig ng mesang kainan upang kung may dumating na bisita ay hindi nakalantad ang mga kumakain. Bago na ang kahoy ng pinto, pero ang balangkas ay iyon pa ring orihinal na gawa sa hindi pangkaraniwang kahoy na matiyagang nililok sa estilong baroque, na popular sa Europa noong ika-17 siglo. Dito sinusukat ang tibay ng kahoy, dahil kahit kaunting reseko, gawa ng salisihang init at lamig ng panahon, ang kahoy ay maaaring bumingkong, pumintad o pumilipit at hindi na lumapat sa hamba. Hindi ko rin makita kung saang panig ng kabahayan nagsulat si Angela. Wala akong makitang eskribania o kahit anong mesang sulatan. Ang mga gamit sa loob ay bagong estante ng mga pigurin at manikin, mga lamisetang bago ang gawa, gusi at tibor sa estilo ay gawa sa tsina, at aparador na nakaharang sa pintuan ng isang silid. CBCP official hits ‘mind-conditioning’ survey on RH bill
Pope says ordaining women is not the Church’s choice to make
manIla, DeC. 1, 2010—an official of the Catholic Bishops’ Conference of the Philippines has called for a stop on surveys on the Reproductive Health bill while the issue is still being debated by the lawmakers. Fr. Melvin Castro, executive secretary of the CBCP’s Commission on Family and Life, fears the surveys are being conducted to influence the decisions of the lawmakers. Castro also expressed concern that surveys are being conducted as a mind-conditioning strategy of those behind the controversial measure. “We are appealing to them (surveying firms) not to be used to mindset legislators that majority of the people is for the bill… so that it will not cause undue influence to our legislators,” said Castro. “It is our impression now that they are trying to influence our legislators,” he furthered. Castro made the statement on Wednesday after the result of Pulse Asia’s latest survey revealed that seven out of 10 Filipinos favoring the RH bill which seeks to promote contraception. The poll shows that 69 percent of Filipinos support the measure, seven percent oppose it, while 24 percent are undecided. The CBCP official, meantime, questioned the manner by which the survey was done by the polling firm. “The question is: Did the questions tackle the bill’s provisions? Or was it a general question on whether they support it or not? It would be good to ask if the people they surveyed have already read the bill or not,” he said. (CBCPNews)
